This website: www.herkey.club (“Website”) is owned and operated by JobsForHer Restart Portal Private Limited (“Company”). Through the Website, the Company provides a platform for professional skill development and networking opportunities for women who are enrolled (each a “Member”) in the HerKey Club (“Club”) for the period specified in the application (“Membership”). Upon gaining Membership status, a Member shall be considered to have subscribed to the services providing them with learning, networking and leadership skill development opportunities (“Services”).

The terms ‘the Company’ or ‘us’ or ‘we’ refer to the owners of this Website. The terms ‘you’ or ‘user’, and all its grammatical variations, refer to the user or viewer of our Website.

This Privacy Policy (“Policy”) reflects the Company’s commitment towards protecting the privacy and personal information provided by users of the Website and sets out the nature and type of information the Company collects from users for the purpose of the Services, the usage and disclosure of such information, and the safety and security measures adopted by the Company to safeguard the information. We respect and safeguard the personally identifiable information ("Personal Information") we receive and collect from you on our Website and in the course of our other interactions online.

Please note that this Policy is only applicable to the users of the Website and the information and data gathered on the Website and not to any other information or website. 2. Information Gathered

In general, you can visit our Website without revealing your identity or any Personal Information (as defined below) about yourself. However, you may not be able to access significant portions and sections of the Website or use the Services unless you subscribe to the Services by enrolling as a Member of the Club, or reveal your identity and/or other information about you. Please note that minors are prohibited from using the Services, and the Company is committed to not collecting Personal Information from any minors viewing the Website.

Information that we collect from you at registration or at any other time may include, inter alia, the following information:

  • username
  • name;
  • address;
  • date of birth;
  • email address
  • phone number;
  • current location;
  • location preference for events;
  • industry;
  • expertise;
  • job type;
  • educational qualifications and details;
  • professional qualifications;
  • specific skill sets;
  • current employer (if any);
  • current designation (if any); and

You understand that the username for your account may be listed publicly, including on your Membership profile page and in search results.

In addition, we may collect demographic information such as information about your computer, location (through GPS), hardware, software, platform, media, Internet Protocol (IP) address and connection, information about online activity such as feature usage and click paths, passwords and other data that you may provide in surveys or while completing your Membership Account profile. We may combine demographic information with Personal Information to tailor our offerings or web pages, including advertising subject matter, to your preferences or interests.

3. Sensitive Personal Information

Sensitive Personal Information (“SPI”) means such personal information which consists of information relating to your password; physical, physiological and mental health condition; medical records and history; biometric information, sexual orientation and financial information (such as bank account details or credit card numbers).

Except for your account password and any SPI that you choose to provide as part of your Membership profile, the Company does not collect any SPI in the course of providing the Services. Any SPI collected by the Company shall not be disclosed to any third party without your express consent, save as otherwise set out in this Policy or the Terms of Use or as provided in a separate written agreement between the Company and you or as required by law. It is clarified that this condition shall not apply to publicly available information, including SPI, in relation to you on the Website.

However, you acknowledge that in the course of providing the Services, the Company may receive SPI, either when you voluntarily choose to update your Membership profile with information related to your identity, physical and physiological condition or financial information, or from such content posted by you on the Website, and you hereby consent and agree to allow the Company to store and display the SPI collected in this manner on the Website and disclose it in accordance with the terms of this Policy.

It is clarified that with respect to any SPI that you may share with the Company, you have the sole right to determine whether you want to share such information with the Company, and that you can continue to avail of the Services without the sharing of any SPI. Further, with respect to any SPI that you may share in the course of updating your Membership profile, you have the right to determine the levels of access to such information, by adjusting the privacy settings of your account with the Website.

In this regard, if you choose to maintain a private profile on the Website, any SPI that you share will be collected only by the Company and may be used to collate statistics or provide Services that you request, but will not be shared with other users of the Website without your consent or unless otherwise required by law. If you choose to maintain a public profile, any SPI you share on your Membership profile or on any public forum, feed or journal, may also be accessed by any visitors to the Website.

4. Personal Information

Personal Information means any information that may be used to identify you and that is not otherwise publicly available, including, but not limited to, your first and last name, age, place of residence and an email address, phone number or other contact information, photograph, as well as any information related to your profession or academic qualifications.

We may collect Personal Information from you when you register and create a Membership account on the Website or apply for a Membership, or otherwise voluntarily choose to contact us or provide such information. Further, in case you apply for Membership in order to use the Services, we may use such Personal Information in order to verify your credentials, for the purpose of permitting continued access to our Services or otherwise to contact you in the course of rendering the Services.

Some of our web pages may also utilise “cookies” and other tracking technologies. 10. Change of Control

In the event that ownership or control of the Company was to change, your SPI and Personal Information may be transferred. If such a transfer results in a material change in the nature of use of your SPI and Personal Information, the Company will provide notice about the choices you have to decline to permit such a transfer of SPI and/or Personal Information, as the case may be.

11. Accuracy

To the extent that you do provide us with Personal Information and SPI, we wish to maintain accurate and current SPI and Personal Information. Where we collect SPI and Personal Information from you on our Website, should you need to update or correct that SPI and Personal Information, please contact us and we will make reasonable efforts to incorporate the changes in your SPI and Personal Information that we hold as soon as practicable. You can obtain the information we currently hold on you by emailing the Company at guardian@herkey.club from the email address provided to the Company at the time of registration on the Website. We will use our best efforts to send you the information within 14 days of receipt of your email.

12. Termination of User Account

In the event that you choose to terminate and delete your user account with the Company, or if your account has been terminated for any other reason, such as a violation of the Terms of Use, the Company shall within a reasonable time, delete and remove all SPI and Personal Information that you may have submitted and stored in your account with the Website. You acknowledge and agree that generic, non-personally identifiable information may continue to be stored and/or displayed by the Company as a part of any surveys or research or tabulations compiled on the Website.

13. Consent and Amendments

By using this Website, you consent to the terms of this Policy and to our use and management of Personal Information and SPI for the purposes and in the manner herein provided. Should this Policy change, we intend to take every reasonable step to ensure that these changes are brought to your attention by posting all changes prominently on our Website for a reasonable period of time. 14. Applicable Law

This Policy and terms contained herein, shall be governed by and construed in accordance with the laws of the Republic of India. Further, it is irrevocably and unconditionally agreed that the courts of Bengaluru, India shall have exclusive jurisdiction to entertain any proceedings in relation to any disputes arising out of the same.
